ResPower, Inc. knows that you care how information about you is used and shared, and we appreciate your trust that we will do so carefully and sensibly. This notice describes our privacy policy. By visiting www.ResPower.com you are accepting the practices described in this Privacy Notice.

Is my intellectual property (IP) safe with ResPower?

Your FTP folder is password protected and hidden from all other users. We take every reasonable precaution to prevent unauthorized access to your account.

ResPower's official policy is that we do not look at your scenes or rendered output unless directed to do so by you; from a practical standpoint, the volume of work we produce is simply too great for us to look at it even if we wanted to.

We do not hand out passwords or usernames via telephone or email other than through our automated "forgotten password" page, which only sends your password to the email address that the account is registered with.

In addition, we are prepared to sign any reasonably crafted nondisclosure agreement (NDA). Things that would make your NDA unreasonable in our view would be things like clauses that restrict us from working with your competitors. Obviously clauses that prevent us from sharing information we learn about your project with your competitors are reasonable, we just cannot restrict ourselves from processing your competitors' work. Even if we wanted to agree to such restrictions, we wouldn't be able to keep promises like that, since our system is highly self-service.

ResPower maintains a secure environment for your information and data. Access to the Super/Farm and computer systems is available only to authorized personnel. No one at ResPower will see your files, prior to rendering or after, unless a technical support issue arises.

If customers are very sensitive about the privacy of their data, and wish to ensure that their files are kept in the strictest confidence, ResPower is willing to sign most generic non-disclosure agreements to make customers comfortable. In the regular course of business, all rendered customer data on the farm is purged every 12 days, and all customer source data is purged every 6 months. ResPower reserves the right to shorten these schedules without notice to you. You should download your output data within 24 hours of completion and you should not rely on ResPower's FTP site for backup purposes for your source data.

Information about our customers is an important part of our business and we are not in the business of selling it to others, period. We share customer information only as follows:

• Business Transfers In the unlikely event that ResPower, Inc., or substantially all of its assets are acquired, customer information will of course be one of the transferred assets.
• Protection of ResPower.com and Others We release account and other personal information when we believe release is appropriate to comply with the law; enforce or apply to other agreements; or protect the rights, property, or safety of ResPower, Inc., our users, or others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction. Obviously, however, this does not include selling, renting, sharing, or otherwise disclosing personally identifiable information from customrs for commercial purposes in violation of the commitments set forth in this Privacy Notice.
• With Your Consent Other than as set out above, you will receive notice when information about you might go to third parties, and you will have an opportunity to choose to share the information.

The information we learn from customers helps us personalize and continually improve your experience on the ResPower Super/Farm™.

We receive and store any information you enter on our Web site or give us in any other way. You can choose not to provide certain information, but then you might not be able to take advantage of many of our features. We use the information that you provide for such purposes as responding to your requests and communicating with you.

We receive and store certain types of information whenever you interact with us. For example, like many Web sites, we use "cookies", and we obtain certain types of information when your Web browser accesses ResPower.com. Cookies are alphanumeric identifiers that we transfer to your computer's hard drive through your Web Browser to enable our systems to recognize your browser. For example, this is how ResPower.com remembers which items you have expanded or collapsed in the Site Map.

We work to protect the security of your information during transmission by using Secure Sockets Layer (SSL) software, which encrypts information you input. We reveal only the last four digits of your credit card when confirming an order with you. Of course, we transmit the entire credit card number to the appropriate credit card company during order processing. It is important for you to protect against unauthorized access to your password and to your computer. Be sure to sign off when you have finished using a shared computer.

ResPower.com gives you access to a broad range of information about your account and your interactions with ResPower.com for the limited purpose of viewing and, in certain cases, updating that information.

As discussed above, you can always choose not to provide information, even though it might be needed. When you update information, we may keep a copy of the prior version for our records.

ResPower.com does not sell products or services for purchase by minors. If you are under 18, you may use ResPower.com only with the involvement of a parent or guardian.

If you choose to visit ResPower.com, your visit and any dispute over privacy is subject to this Notice, including limitations on damages, arbitration of disputes, and application of the law of the state of Alabama. If you have any concern about privacy at ResPower.com, please contact us with a thorough description, and we will try to resolve it.

Our business changes constantly, and our Privacy Notice and the Conditions of Use will also change. We may email periodic reminders of our notices and conditions, unless you have instructed us otherwise, but you should check our Web site frequently to see recent changes. Unless stated otherwise, our current Privacy Notice applies to all information that we have about you and your account. We stand behind the promises we make, however, and will never materially change our policies and practices to make them less protective of customer information collected in the past without the consent of affected customers.
